State Senator Anthony Galluccio, who is currently serving a 6-month home confinement for a hit-and-run case, has failed several random breath analyzer tests. The Senator pleaded guilty on Friday to a hit-and-run case in Cambridge last October 4 that injured two people, one of them a 13-year old boy. He also vowed to abstain from alcohol.

anthony galluccioSenator Galluccio reportedly admitted to registering several “low-level positive readings over the course of an hour”. The positive readings, however, are being blamed on the senator’s choice of toothpaste, according to several news reports. The senator was quoted with the following statement: “After discussing it with a physician, we have determined that is the result of my using two toothpastes – Colgate Total Whitening and Sensodyne Toothpaste, both of which contain sorbitol. While I knew that mouthwash or cold medicine would set the machine off, it did not occur to me that toothpaste would.”

The readings, however, are in violation of the terms of the senator’s probation. His sentence from last week, where he was said to have vowed that alcohol was no longer going to be “part of his life” called for home confinement for a period of six months, staying away from alcohol, consenting to random alcohol testing and a $1,000 fine. He is allowed, though, to attend formal sessions of the Senate, take a vote, and attend Sunday church services with his mother.

Senator Galluccio has been issued a notice of violation of probation, a notice of surrender, and a notice for the conduct of a detention hearing which has been scheduled for Wednesday, according to Probation spokesperson Coria Holland.
